Virginia SOL CE.5

CE.5 is a Standards of Learning history and social science standard. These are the skills expectations under it.

  describing the system of state and federal courts, including, but not limited to jurisdiction and judicial review

  comparing and contrasting civil and criminal cases

  explaining the effects of Supreme Court cases affecting the judiciary, including, but not limited to Marbury v. Madison.

What Students Need to Do

Students explain how Virginia and federal courts are organized and decide which courts can hear different cases. They distinguish civil cases from criminal cases, identify due-process protections, and explain judicial review through Marbury v. Madison.

What Mastery Looks Like

Students can place a case in the correct court system and justify the choice using jurisdiction. They can classify cases, identify required protections, and explain how courts may declare a law unconstitutional.

Common Misconceptions

Students often assume every case can reach the Supreme Court or that federal courts outrank state courts in all matters. They may confuse civil lawsuits with crimes, or think due process guarantees a favorable result.

How to Assess It

Give students one case scenario and ask them to name the court system, classify the case, identify one due-process protection, and explain whether judicial review applies.

   Have groups sort case cards onto Virginia and federal court ladders, then label each court's jurisdiction.

   Ask students to write which due-process protection matters most during a criminal trial and defend their choice with one example.

   Play Courtroom Challenge, where teams classify scenario cards as civil or criminal and choose the proper court system.

   Use a current local lawsuit or criminal case summary to trace how the case could move through appeals.
