What This Standard Means
What Students Need to Do
- Students compare the structure and roles of Virginia and federal courts. They identify which court has jurisdiction and explain how judicial review can invalidate unconstitutional laws or government actions.
What Mastery Looks Like
- Students can place major state and federal courts in order and match cases to the proper court. They distinguish original from appellate jurisdiction and explain judicial review with an example.
Common Misconceptions
- Students may think federal courts can hear every case or that they always outrank state courts. They may confuse an appeal with a new trial or judicial review with reviewing a verdict.
How to Assess It
- Give students three case scenarios and ask them to name the likely court system and jurisdiction. Add one sentence explaining whether judicial review could apply.
