What Students Need to Do: Students explain that government must follow fair, established steps before taking a person's life, freedom, or property. They identify protections such as notice, a fair hearing, and a chance to respond.
What Mastery Looks Like: Given a short scenario, students can decide whether fair legal procedures were followed and name any missing protection. They can explain that due process promises fair treatment, not a preferred outcome.
Common Misconceptions: Students may think due process applies only in a courtroom or guarantees that an accused person goes free. They may also confuse fair procedures with equal outcomes.
How to Assess It: Give students this exit prompt: “A city takes Maya's property without warning or a hearing. Was due process followed? Explain using two protections.”

Lesson moves

Run a mock school hearing using a notice card, evidence cards, a student response, and a neutral three-person panel.
Write: Why must the government hear a person's side before taking freedom or property?
Play a scenario sort, placing cards under due process followed or due process denied, then defend each choice.
Read a sample school suspension notice and mark where the student receives notice and a chance to respond.
