What Students Need to Do: Students name the Constitution when asked which document has the highest authority in United States government. They explain that laws and government actions must follow it.
What Mastery Looks Like: Given several government documents, a student selects the Constitution and explains the choice. The student can state that presidents, lawmakers, and states must follow it.
Common Misconceptions: Students may confuse the Constitution with the Declaration of Independence. They may think the president has greater authority or that the Constitution lists every law in the country.
How to Assess It: Display the words Constitution, Declaration of Independence, and state law. Ask students to circle the highest authority and write one sentence explaining why.

Lesson moves

Give pairs a Constitution card and cards for federal, state, and local laws; place the Constitution above all laws and explain why.
Ask, “Why should the president, Congress, and states all have to follow the Constitution?” Students write two sentences, then share.
Play Which Document: read clues about the Constitution, Declaration, and Bill of Rights, and students hold up the matching document card.
Compare the Constitution’s role to a school’s main rulebook, then name one way the comparison is useful and one way it differs.
