What This Standard Means
What Students Need to Do
- Students explain that laws limit both citizens and government officials, rather than allowing leaders to act on personal will. They connect that principle to written constitutions, courts, due process, checks and balances, and lawful transfers of power.
What Mastery Looks Like
- Given a scenario, students can decide whether government action follows known laws or depends on an official's personal choice. They support the decision with evidence and name a U.S. safeguard designed to limit power.
Common Misconceptions
- Students may think the phrase means simply obeying any law, even when officials apply it selectively or ignore legal limits. They may also confuse equal treatment under law with identical punishments or outcomes in every case.
How to Assess It
- Exit ticket: A mayor orders police to jail a critic without charges or a hearing. Explain what principle is violated and name one U.S. safeguard that should block the action.

Ways to Teach It
Give groups scenario cards to sort under lawful government or arbitrary government, then require one piece of evidence for each choice.
Ask students to write: Why should a mayor, police officer, and citizen face the same legal limits?
Play Rule of Law Relay, with teams matching Constitution, courts, due process, and checks and balances to problems they prevent.
Use a current news report about an official investigation, and have students identify where legal limits, courts, or due process appear.
