What This Standard Means
What Students Need to Do
- Students identify whether the government is prosecuting an offense or one party is asking a court to settle a dispute. They compare the parties, purpose, and possible outcomes in each case.
What Mastery Looks Like
- Students correctly classify unfamiliar case examples and support each choice with details from the facts. They explain how one event can lead to prosecution and a separate lawsuit.
Common Misconceptions
- Students may think every court case can result in jail or that police bring civil lawsuits. They may also classify cases by seriousness instead of looking at who filed the case and what outcome is sought.
How to Assess It
- Give this exit ticket: “The state charges a driver with reckless driving, and an injured cyclist sues for medical costs. Classify each case and explain why.”

Ways to Teach It
Give pairs 12 case cards and two labeled folders; students sort each card, then underline the party and requested outcome.
Ask students to write which case type better fits a damaged rental property dispute, then defend their answer with two details.
Play “Case Court”: read short scenarios aloud, and teams hold up criminal or civil cards before explaining their choice.
Use a local crime report and a consumer dispute article; students identify the parties, court purpose, and likely outcomes.
