The Standard
The Constitution established three branches of government as well as a system of checks and balances that guides the relationship between the branches. Individual rights of citizens are addressed in the Bill of Rights.

THE CONSTITUTION IN PRACTICE: The United States Constitution serves as the foundation of the United States government and outlines the rights of citizens. The Constitution is considered a living document that can respond to political and social changes. The New York State Constitution also has been changed over time.

What This Standard Means
What Students Need to Do
- Students compare the jobs and powers of Congress, the president, and the Supreme Court. They trace passage, veto, and override, then consider possible court review if a law is challenged. They also connect everyday situations to rights protected by the first ten amendments.
What Mastery Looks Like
- Students correctly assign lawmaking, enforcement, and constitutional review to the proper branches. They explain how one branch can limit another and identify a protected right in a short scenario.
Common Misconceptions
- Students may think the president makes laws alone or that the Supreme Court writes laws. They may confuse equal branches with identical powers. They may also assume protected rights have no legal limits.
How to Assess It
- Exit ticket: Congress passes a bill limiting peaceful protest, the president vetoes it, and Congress overrides the veto. Explain each branch’s role, what the Supreme Court could do if challenged, and which right is involved.
Lesson moves
Ways to Teach It
Sort power and rights cards under Congress, president, Supreme Court, or Bill of Rights, then explain two placements.
Discuss: Which branch should have the final say when a law may violate individual rights, and why?
Race teams to arrange bill process cards, then draw challenge cards such as veto, override, or court review.
Use a current news article to identify the branch involved, its action, any check used, and any protected right.
